FirstClass.com.au Membership Conditions

1. Introduction
These Terms and Conditions form the basis of Firstclass.com.au. They are intended to protect you as a Member of Firstclass.com.au. It is your responsibility to read and understand them. 

2. Program Changes

2.1 Firstclass.com.au reserves the right at all times to make any changes to the Firstclass.com.au Terms and Conditions, Benefits offered and the Schedule of Fees in its sole discretion.  

2.2 Firstclass.com.au will use all reasonable endeavours to advise Members of any changes to these Terms and Conditions, notifies the Member of the change by any method including but not limited to by providing notice at an address provided to Firstclass.com.au by the Member and/or by posting details of the changes on its website, but will not be liable in any way for any failure to do so.

2.3 Firstclass.com.au gives no warranty as to the continuing availability of any Benefits.

3.   Termination 

3.1 Firstclass.com.au gives no warranty as to the continuing availability of FirstClass Membership Program. Firstclass.com.au reserves the right to terminate or suspend this program at any time. 

3.2 Membership will terminate automatically on the death of a Member. Firstclass.com.au will terminate the Member's account on receipt of notification of the death of the Member.

4. Breach of Terms and Conditions

4.1 Any breach of these Terms and Conditions by a Member whether intentional or otherwise may result in suspension or termination of membership and/or cancellation of Benefits at the sole discretion of Firstclass.com.au. 

4.2 Firstclass.com.au is not, and will not be, liable for any Member's benefits or Awards. In the event of suspension or termination of membership or termination or other material alteration to the members, such Benefits or Awards may also terminate or be extinguished.. 

5. Member Obligations

5.1 Members must not:
.	abuse Benefits, facilities, services or arrangements accorded to the Member as a result of membership;
.	act in any way which is likely to be detrimental to the interests of Firstclass.com.au;
.	supply or attempt to supply misleading information, or make any misrepresentation to Firstclass.com.au; or 
.	act in any way which in Firstclass.com.au' reasonable opinion breaches or is likely to breach these Terms and Conditions or is inconsistent with the intent of these Terms and Conditions. 

5.2 Members must comply with these Terms and Conditions at all times.

6. Membership

6.1 Membership of Firstclass.com.au is open only to individuals. Membership is not open to: families, groups, companies; trusts, partnerships; other entities or government departments or agencies. Firstclass.com.au may extend some of the membership benefits to your immediate family (spouse and children) at its discretion.  Membership and its benefits are offered at the discretion of Firstclass.com.au, and Firstclass.com.au has the right to accept or reject any application for membership in its sole discretion.

6.2 Each Member may maintain only one Firstclass.com.au account that must serve all business and personal needs. Should you indicate to us within two weeks of receiving your membership kit that you would like to withdraw from being a Firstclass.com.au member, we will cancel your membership and refund your membership fee (if any) provided you have not used your membership. Otherwise, Membership is non-refundable and not is transferable.

6.3 Each Member will be assigned a membership number upon acceptance of enrolment. Each Member will also be assigned a Personal Identification Number (PIN) which along with his/her membership number, surname, mother's maiden name, birth date, and/or recent travel details will be used for security of membership information. It is the Member's responsibility to ensure that this PIN is kept secure and other security information is kept secure. 

6.4 The Member's mailing address will be used to determine their eligibility for promotions and other offerings. Changes to address can be made directly on the website (you must supply your PIN) or by calling our office. Each Member must advise Firstclass.com.au of any change of name, address, or other details as soon as practicable after the change. Firstclass.com.au is not responsible for any failure by the Member to adequately notify Firstclass.com.au of the change. Written proof must be supplied for any change of name. 

6.5 It is a condition of membership that you consent and authorise Firstclass.com.au to provide the information on your application form and other information that you provide to Firstclass.com.au and any other person (including without limitation a related body corporate, agents and contractors) for the purpose of:
(i) Firstclass.com.au providing services; 
(ii) Firstclass.com.au improving Firstclass.com.au customer service, including by means of research, marketing, product development and planning; 
(iii) Firstclass.com.au marketing its products or services or the products or services of its partners; and 
(iv) any third party providing services to Firstclass.com.au and Members in connection with the administration. 

This information will be transferred to or from Australia for these purposes. If all or any part of the requested information is not provided by the Member, the services provided to you by Firstclass.com.au may be affected. 

6.6 Firstclass.com.au will provide you with access to and correction of your personal information held by Firstclass.com.au on request by you to the extent permitted or required by law. Only the Member named on the account will be entitled to access account information. However, Firstclass.com.au does comply with validly served and executed court orders and subpoenas and cooperates with investigations by state and federal agencies in accordance with internal Firstclass.com.au policy. Under these circumstances, or where otherwise required by law, your account information may be shared with others with or without your knowledge or consent.

7. Use of the Card, Membership Number and Benefits

7.1 By using the Card, membership number or claiming any Benefit, the Member agrees to be bound by the Terms and Conditions and provides the consent specified in clause 6.5. 

7.2 The Card is and will remain the property of Firstclass.com.au and must be returned on demand. It is not a credit card. 

7.3 The Card and membership number are valid for use only by the Member and are not transferable in any circumstances. The Card is valid for use only during the period indicated on it. 

7.4 Firstclass.com.au reserves the right to require the Member to quote their membership number at any time while ticketing or while the Member is travelling or otherwise claiming or utilising any Awards or Benefits. 

7.5 In the event of loss, theft or unauthorised use of your Card or unauthorised use of your membership number, it is your responsibility to immediately advise our office. Until loss, theft or unauthorised use of the Card is notified to Firstclass.com.au, the Member is liable for all use of the Card or membership number. Firstclass.com.au will not be liable for misuse of a lost or stolen Card or any unauthorised use of a Card or membership number or PIN.
